$170,000 Class and Representative Action Settlement Granted Preliminary Approval by the Superior Court for the County of San Francisco


 

On June 25, 2021, the California Superior Court for the County of San Francisco granted preliminary approval of a $170,000 class and representative action settlement in Epter v. Downtown Streets, Inc. action (Case No. CGC-19-579955). The settlement is on behalf of all former and current employees of Downtown Streets, Inc. who worked as “Employments Specialist” or “Case Managers” in California at any time between October 11, 2015 and March 31, 2020. 

The lawsuit alleges that Downtown Streets misclassified “Employments Specialists” and “Case Managers” as workers exempt from the protections of the California Labor Code. Stemming from this misclassification, the lawsuit alleges that Downtown Streets failed to pay “Employments Specialist” and “Case Managers” for all hours worked, including overtime hours; failed to provide workers with lawful meal and rest breaks; failed to provide workers with accurate itemized wage statements; and failed to timely pay all  wages owed to workers who resigned or were terminated. Downtown Streets denies the allegations. After a thorough investigation by Plaintiff’s counsel and a full-day mediation session before an experienced mediator, the parties agreed on the proposed Settlement that was preliminarily approved by the Court on June 25, 2021. 

The Court will hold a Final Approval Hearing on November 9, 2021 at 2:00 p.m. in Department 304 of the San Francisco County Superior Court, located at 400 McAllister St, San Francisco, CA 94102. You can learn more about the settlement from the following documents:
