$4,000,000 Class Action and PAGA Settlement Granted Preliminary Approval in the Bay Clubs Wage and Hour Cases

On June 10, 2026, the Superior Court of the State of California, County of Alameda, granted preliminary approval of a $4,000,000 class action and representative (“PAGA”) settlement in the wage and hour class and representative action entitled Francisco Diosdado Miranda, et al. v. The Bay Clubs Company, LLC (Case No. RG21105433).

The lawsuit alleges violations of California wage-and-hour laws, including claims for: all hours worked, including time at the true start and end of work periods and meal periods, the time that was recorded and rounded, shaved, or altered, administrative time, time spent performing pre and post service, making class sales, time spent interacting with customers, scheduling and planning individual and group classes, taking training or certification courses, as well as time spent performing other work activities that were not directly compensated by the piece rate/commission/incentive; failure to include the incentive compensation, as well as other non-discretionary pay, such as shift differential pay, premiums, commissions, and bonuses, as part of the “regular rate of pay” for purposes of calculating overtime pay and meal and rest break premium pay; for meal and rest period violations, unreimbursed business expenses, wage statement violations, waiting time penalties, sick pay violations, and related claims under California’s Private Attorneys General Act (“PAGA”). Defendant denies all allegations of wrongdoing.

The proposed settlement covers current and former non-exempt employees who worked for The Bay Clubs Company, LLC in California during the class period from January 16, 2017 through March 30, 2026.

A Final Approval Hearing has been scheduled for September 16, 2026, at 1:30 p.m. in Department 18 of the Alameda County Superior Court.
