$425,000.00 Class and Representative Action Settlement Granted Preliminary Approval by the San Francisco County Superior Court 


 

On April 19, 2022, Judge Ethan P. Schulman of the San Francisco County Superior Court granted preliminary approval of a $425,000 class and representative action settlement in Maria Victoria Reyes, et al. v. The Whole Cart, LLC, et al., (Case No. CGC-20-584861). The settlement is on behalf of all non-exempt employees employed by Defendants performing food preparation and cooking services in Defendants’ kitchens, except any employee who held the position of “InsTrucktional Entrepreneur,” within the State of California from June 1, 2016 through April 19, 2022. 

The lawsuit claims that Defendants failed to pay for all hours worked; failed to pay for all hours worked; failed to pay minimum wages; failed to provide paid rest breaks; failed to provide meal periods; failed to furnish accurate itemized wage statements; failed to timely pay final wages at resignation/termination; failed to reimburse necessary business expenses; failed to produce or permit inspection of records; failed to produce records in response to statutory request;  violation of the Unfair Competition Law; and civil penalties pursuant to the Private Attorneys General Act (“PAGA”). Defendants deny Plaintiffs’ claims and deny they did anything wrong.  

The Court will hold a Final Approval Hearing is scheduled to take place on September 16, 2022, at 9:00 a.m. in Department 304 of the San Francisco County Superior Court, located at 400 McAllister Street, San Francisco, CA 94102.
