$600,000.00 Class and Representative Action Settlement Granted Preliminary Approval by the Alameda County Superior Court
On May 22, 2023, Judge Brad Seligman of Alameda County Superior Court granted preliminary approval of a $600,000 class and representative action settlement in Pena v. KPS Alarms, Inc., et al., (Case No. RG18927434). The settlement is on behalf of all individuals who were employed by the company defendants in California as non-exempt employees at any time(s) between November 1, 2014 through May 22, 2023.
The case was filed by Plaintiff Hugo Pena alleging class-wide violations of California wage and hour law and individual claims of disability discrimination. The lawsuit claims the following class allegations: failure to pay for all hours worked; failure to pay minimum wages; failure to paid overtime wages; rest breaks and meal break violations; wage statement violations; failure to reimburse necessary business expenses; waiting time penalties; violation of the Unfair Competition Law; and civil penalties pursuant to the Private Attorneys General Act (“PAGA”).
The Court will hold a Final Approval Hearing regarding the proposed settlement on October 24, 2023, at 3:00 p.m. in Department 23 of the Alameda County Superior Court, located at 1221 Oak St., Oakland, CA 94612.
