$950,000 Class Action Settlement Granted Preliminary Approval in The Whole Cart Wage and Hour Cases
On January 6, 2026, the Superior Court of the State of California, County of Alameda, granted preliminary approval of a $950,000 class action settlement in The Whole Cart Wage and Hour Cases (JCCP No. 5280), involving The Whole Cart, LLC and Off the Grid Services, LLC .
The settlement resolves claims alleging violations of California wage-and-hour laws, including failure to pay all wages earned, minimum and overtime wages, failure to provide compliant meal and rest periods, failure to reimburse business expenses, waiting time penalties, and unfair competition. Defendants deny all allegations of wrongdoing.
The proposed settlement covers approximately 511 current and former non-exempt employees who worked for The Whole Cart, LLC and Off the Grid Services, LLC in California during the class period, from September 19, 2018 through January 6, 2026, excluding certain employees whose claims were previously released under the Reyes and O’Neal-Roberts settlements.
A Final Approval Hearing has been scheduled for July 14, 2026, at 2:30 pa.m. in Department 21 of the Alameda County Superior Court.
