$448,000 Class and Representative Action Settlement Granted Preliminary Approval by the San Francisco County Superior Court

On March 7, 2022, Judge Ethan P. Schulman of the San Francisco County Superior Court granted preliminary approval of a $448,000 class and representative action settlement in Segura v. Altia Transportation Corporation and Thomas Gasparini, (Case No. CGC-20-586926). The settlement is on behalf of all former and current employees , who work or have worked as non-exempt delivery drivers for Altia Transportation and/or Thomas Gasparini within the state of California from September 16, 2016, through March 7, 2022.  

The lawsuit claims that Defendants failed to pay for all hours worked; failed to pay overtime wages; failed to provide paid rest breaks; failed to provide meal periods; failed to furnish accurate itemized wage statements; failed to timely pay final wages at resignation/termination; failed to reimburse necessary business expenses; failed to produce records in response to statutory request;  violation of the Unfair Competition Law; and civil penalties pursuant to the Private Attorneys General Act (“PAGA”). Defendants deny each of Plaintiff’s allegations, deny that the claims are appropriate for class certification, and contend that it has complied with all applicable laws of California and otherwise with respect to the claims alleged by Plaintiff.   

The Court will hold a Final Approval Hearing at 9:00 a.m. on June 22, 2022, in Department 304 of the San Francisco County Superior Court, located at 400 McAllister St, San Francisco, CA 94102, to determine whether the settlement should be finally approved as fair, reasonable, and adequate.
