$275,000 Class Action Settlement Granted Preliminary Approval by San Diego County Superior Court
On December 2, 2020, Judge Timothy M. Casserly of the California Superior Court for the County of San Diego granted preliminary approval of a $275,000 class and collective action in the matter of Irene Ramirez v. Heritage Hotel Group, Inc. and Maruti Investments, LLC, Case No. 37-2019-00052128-CU-OE-NC. The conditionally certified settlement class consists of approximately 67 current and former non-exempt employees, excluding office workers, who have worked at the La Quinta Inn & Suites in Carlsbad, California at any time between May 19, 2016 through December 2, 2020.
The lawsuit claims that Defendants failed to pay La Quinta workers overtime for hours over 40 in a workweek; failed to pay for all hours worked; failed to provide proper meal periods; failed to provide rest periods at the rates required under State law; failed to provide workers with accurate itemized wage statements; and failed to time pay all wages owed to workers who resigned or were terminated. Defendants deny Plaintiff’s claims and deny they did anything wrong.
The Court will hold a Fairness Hearing at 1:30 p.m. on March 19, 2021 in Department N-31 of the San Diego Superior Court located at 325 South Melrose Dr., Vista, CA 92081, to determine whether the settlement should be finally approved as fair, reasonable, and adequate.
